These Terms of Service (“Terms”) govern your access to and use of Kharisvie.com and your purchase of Kharisvie products. By using the site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By using the site, you represent that you meet this requirement.

2. Account registration

You may create an account to track orders and save addresses. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Products and pricing

We strive to display product descriptions, photographs, and pricing accurately. Colors may appear slightly different on your screen than in person. Prices are in U.S. dollars and exclude applicable taxes and shipping. We reserve the right to correct pricing errors and cancel any order placed at an incorrect price; in that case, we issue a full refund.

4. Orders and payment

By submitting an order, you make an offer to purchase. We reserve the right to accept or decline any order. Payment is processed at the time you place the order. We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, and PayPal. All transactions are processed by PCI-compliant payment partners.

5. Shipping, risk of loss, and returns

Shipping methods, delivery times, and risk of loss are governed by our Shipping & Returns policy and Refund & Returns Policy, both incorporated by reference. Title and risk of loss pass to you when the carrier delivers the product to your address.

6. Promotions and discount codes

Promotional codes are non-transferable, have no cash value, and may not be combined unless explicitly stated. Codes expire on their published date. We reserve the right to refuse a code that has been used in a way inconsistent with our promotional terms.

7. Intellectual property

All content on Kharisvie.com — including the Kharisvie name and logo, product names, photography, copy, designs, and code — is owned by Kharisvie, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, or distribute any content without our prior written consent, other than for personal, non-commercial use.

8. User content

If you submit reviews, comments, photos, or other content to us or through our site or social channels, you grant Kharisvie a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including in marketing and on our site. You represent that you own or have the right to share the content.

9. Prohibited uses

You agree not to:

  • Use the site for any unlawful purpose or to harass, threaten, or defraud others
  • Interfere with the site’s operation, security, or other users’ access
  • Use bots, scrapers, or automated tools to access the site without our written consent
  • Submit false or misleading information
  • Resell Kharisvie products without authorization (see our wholesale terms by emailing us)

10. Disclaimers

Kharisvie products are sold “as is” for personal cosmetic use. We make no medical claims and our products are not intended to diagnose, treat, cure, or prevent any condition. Patch-test hair-care products before first use if you have known sensitivities. Follow the product instructions for safe use of heated styling tools.

The site is provided “as is” without warranties of any kind, express or implied, except where required by law.

11. Limitation of liability

To the maximum extent permitted by law, Kharisvie’s total liability for any claim arising from your use of the site or our products is limited to the amount you paid for the product giving rise to the claim. Kharisvie is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

12. Indemnification

You agree to indemnify and hold harmless Kharisvie, LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the site or our products.

13. Modifications

We may update these Terms from time to time. Material changes will be noted on this page with a new “Last updated” date. Your continued use of the site after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site must be brought in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

Before filing any dispute, you agree to first contact us at support@kharisvie.com and try in good faith to resolve the issue informally for at least 30 days.
